If You Let a Property in Bradford

The Law Says You Need This. Here Is What It Actually Means.

The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 made an Electrical Installation Condition Report a legal requirement for every Bradford rental property. The rules came in on 1 June 2020 and applied to all existing tenancies from 1 April 2021. Bradford Council enforces them with civil penalties of up to £30,000 per breach.

Most landlord-EICR websites quote a price and walk away. We take five minutes first to explain exactly what you owe the tenant, what you owe the council and what the EICR actually proves. The Five Duties Every Bradford Landlord Has

The regulations are short but easy to miss in the detail. Below are the five specific things you must do as a Bradford landlord. Miss any one of them and the council can fine you.

  1. Get a satisfactory EICR every 5 years

    Every tenanted property must have a satisfactory Electrical Installation Condition Report renewed at least every 5 years. The clock resets each time you receive a fresh satisfactory report. A satisfactory report has no C1, C2 or FI codes. C3 codes are recommendations only and do not fail the report.

  2. Provide the EICR to existing tenants within 28 days

    Within 28 days of the inspection date, every existing tenant must receive a copy of the report. Email is fine, paper is fine, both are best. Keep proof of delivery (email timestamp, signed delivery receipt) in your records.

  3. Provide the EICR to new tenants before they move in

    A new tenant must be given a copy of the current EICR before they sign and occupy the property. This is the pre-tenancy duty. Many letting agent disputes start here, when a tenant moves in without ever seeing the EICR and later raises a complaint.

  4. Provide the EICR to prospective tenants within 28 days of a written request

    If a prospective tenant writes asking for a copy of the report before they decide whether to take the property, you have 28 days to send it. A written request includes email and lettings-platform messages, not just a posted letter.

  5. Provide the EICR to Bradford Council within 7 days if requested

    The council can ask for a copy at any time, with or without a tenant complaint. You have 7 days from the date of the request. Failure to respond opens you to enforcement action including remedial notices and civil penalties.

Bradford Council Enforcement and the £30,000 Penalty

The City of Bradford Metropolitan District Council is the enforcement authority for the PRS Regulations 2020 within the Bradford district. The council has the power to:

  • Serve a remedial notice on a landlord requiring remedial works to be completed in a defined window.
  • Carry out the works themselves if the notice is not complied with, and recover the cost from the landlord.
  • Impose a civil penalty of up to £30,000 per breach. Multiple breaches stack.

HMOs and Selective Licensing

HMO EICRs in Bradford: What Is Different

If you let a House in Multiple Occupation in Bradford, your EICR sits inside a wider compliance regime. The EICR itself is the same inspection. The paperwork around it is not.

When does my Bradford property need an HMO licence?

Under the Housing Act 2004 Part 2, a property is a mandatory HMO if it is occupied by 5 or more people forming 2 or more households, sharing facilities like a kitchen or bathroom. Bradford Council issues mandatory HMO licences for any property meeting this test, valid for 5 years (which conveniently matches the EICR renewal cycle).

If you have a smaller HMO (3 or 4 tenants forming 2+ households), you may still need a licence depending on whether the council has designated additional licensing in your area. What an HMO licence requires you to evidence: a current valid EICR, gas safety certificate, fire safety risk assessment, smoke alarm interconnection, room sizes meeting minimum bedroom standards, and emergency lighting where applicable.

What does an HMO EICR look like in practice?

Technically an HMO EICR is the same BS 7671 inspection as a single-let EICR. In practice three things change:

  • Scope. We test every shared area circuit (kitchens, hallways, communal lighting, smoke alarm circuits, emergency lighting) AND every individual let-room circuit.
  • Timing. HMO inspections take longer because there are more circuits and access to tenant rooms needs scheduling. A 6-bed HMO typically takes 4 to 6 hours.
  • Reporting. We issue the EICR in the format that satisfies the HMO licence renewal: per-circuit results, summary of any C1/C2/FI codes, photo evidence, and a fixed remedial quote.

If your HMO licence is due for renewal, book the EICR 6 to 8 weeks before the licence expiry date so any remedial work is closed off before the council reviews your renewal application.

The 5-Document Bradford Landlord Compliance Checklist

The EICR is one of five documents every Bradford landlord must hold and refresh on the right cycle. Print this list, keep it in the landlord file with the certificates themselves. The council can ask for any of them on inspection.

  • Electrical Installation Condition Report (EICR). Required for every tenancy. Renew every 5 years. Provide to tenants within 28 days of inspection. Provide to council within 7 days of request. From £140 + VAT (this page).
  • Gas Safety Certificate (CP12). Required if the property has any gas appliances. Renew annually. Provide to tenants within 28 days. Arranged through a Gas Safe registered engineer (we are not Gas Safe registered, but will recommend a local engineer if you do not have one).
  • Energy Performance Certificate (EPC). Required before letting. Minimum rating E for new lets and renewals. Valid for 10 years. EPC is a separate inspection from the EICR.
  • Smoke alarm and CO alarm log. Smoke alarms required on every storey. CO alarms required in any room with a fixed combustion appliance. Test at the start of each tenancy and keep a log of dates and results. We test and replace as part of EICR remedial where needed.
  • HMO licence (if applicable). Required for any HMO meeting the 5+ tenant / 2+ household test, plus any property in a council-designated additional or selective licensing area. Valid 5 years. The current EICR is a licence condition.

Do I legally need an EICR for my Bradford rental?

Yes. Every Bradford landlord letting a property to private tenants is legally required to hold a satisfactory EICR under the Electrical Safety Standards in the Private Rented Sector Regulations 2020. The duty applies to all assured shorthold tenancies and most other private rentals. Houses occupied by the freeholder, lodgers in the owner's home, and certain student-hall accommodation are outside the scope. How often does my Bradford landlord EICR need renewing?

Every 5 years from the date of the last satisfactory report, OR sooner if the previous report specified a shorter interval. Some properties (older installations, partial-rewired homes, properties with previous C2 codes) get a 3-year or 4-year recommended interval rather than the default 5. Always check the "Next Inspection" date on the front page of your current EICR. Book the new inspection at least 4 weeks before that date to leave room for any remedial work.

What happens if I do not have a valid EICR in Bradford?

Bradford Council can serve you a remedial notice requiring the inspection to be done within a defined period. If the notice is ignored, the council can carry out the inspection itself and recover the costs from you, AND impose a civil penalty of up to £30,000 per breach. Multiple breaches stack. Beyond the financial penalty, you also lose the legal ability to evict tenants under Section 21 if you cannot evidence compliance with all required certificates. The reputational and tenancy-management consequences usually outweigh the fine.

Do I need an EICR for every property in my portfolio?

Yes. The duty applies per-tenancy, not per-landlord. Every let property in your portfolio needs its own satisfactory EICR, even if you only acquired the property a month ago. What happens if my EICR comes back Unsatisfactory?

If any C1, C2 or FI codes are present, the report is Unsatisfactory and the regulations require the remedial work to be completed within 28 days of the report date (or sooner if the report specifies). We quote remedial at the same time as issuing the report with a fixed price, so there is no second negotiation. Most Bradford landlord remedials are done within a week, well inside the 28-day window. After the work is complete we either issue a Minor Works Certificate (small remedials) or a fresh satisfactory EICR (larger scopes like consumer unit upgrades).

Does my Bradford HMO need a different EICR?
